Inyo County, CA – With ballots already printed and the election for the Bishop Unified School Board approaching in less than a month, candidate Scott Gadea cannot formally withdraw from the race. The Inyo County Elections Office has confirmed that Gadea remains on the ballot and can still be elected, even as he stated his intention to prioritize family.
Danielle Sexton from the Inyo County Elections Office responded to inquiries regarding the situation, stating that it is too late for Gadea to choose to drop out of the election. At this stage, candidates have limited options. Sexton clarified that Gadea’s only recourse is to request that voters not cast their ballot for him. He also retains the option to endorse another candidate if he chooses to do so.
However, the legal framework for elected office in California outlines specific obligations for candidates. If Scott Gadea is elected as one of the top three candidates for the Bishop Unified School Board, he would be obligated to take office. This requirement stems from a statement all candidates are required to sign during the election process.
Sexton detailed the commitment made by those seeking election, explaining that all candidates sign a statement affirming their intent to accept nomination or election. This pledge states that candidates agree to accept the nomination or election and will not withdraw, unless state law permits it. This agreement legally binds elected individuals to serve unless particular state laws provide an exemption.
Therefore, should Gadea be elected to the Bishop Unified School Board, he would first be required to accept the nomination. Any subsequent decision to step down from the position would then involve a formal resignation. Such a resignation would only be permitted if it aligns with the bylaws established by the district board.
Scott Gadea previously communicated that he is "choosing at this time family and the priorities that matter most." While acknowledging the personal nature of this decision, the established timelines and legal commitments of the election process mean that Gadea's name will appear on the ballot. The upcoming election will proceed with Gadea listed as a candidate for the Bishop Unified School Board.
